Blocking An Unconstitutional Law

They tried to pass laws that were clearly unconstitutional against gun ownership in New Jersey, and we didn’t have to wait until the Supreme Court got around to acting to get rid of them. A local judge declared them unconstitutional and blocked the City of Pittsburgh from enforcing them. In so doing, he prevented the damage that would inevitably be done illegally by those laws being enforced until the Supreme Court declared them unconstitutional. It’s common for lawmakers to make clearly unconstitutional laws and enforce them until the Supreme Court acts, which sometimes takes a long time. They can do that because the Founders made the mistake of not providing punishment for lawmakers who make such unconstitutional laws, other than simply having them reversed. Lawmakers who make laws that they KNOW are clearly unconstitutional should be punished. But that’s not likely to happen, since it is those lawmakers themselves that would have to vote FOR such a law. And they will not. The “toothpaste is out of the tube.” We can’t go back now and put it back in. The only thing we can do is remain vigilant, so we can intercept attempts. Then we can go on to vote those legislators out of office so they cannot any longer make such laws. (The Gun Feed)
